NLC Energy collects information from you when you choose to share it with us, such as when you purchase products or services, request information from us, request customer support, or otherwise communicate with or contact us.  The information we collect may include your name, address, email address, telephone or mobile number, and payment information.

In the last 12 months, NLC Energy has disclosed the following categories of personal information for a business purpose (such as with our service providers who are restricted from using your personal information outside the scope of their services for NLC Energy):

  • Protected Classification Information, disclosed to Billing Service Providers, Email/SMS Service Providers, Customer Service and Intelligence Platforms, Network Security and Fraud Protection Services, and Cloud Data Storage Providers;

  • Commercial Information, disclosed to Billing Service Providers, Email/SMS Service Providers, Customer Service and Intelligence Platforms, Network Security and Fraud Protection Services, Campaign Optimization Service Providers, and Cloud Data Storage Providers;

D. Access, Deletion, and Correction Requests

 

If you are a California resident, you may request that we disclose what personal information we collect, use, disclose, and may sell about you. In particular, you may:

  • Request, up to two times each year, that we disclose to you:

    • the categories and specific pieces of personal information that we collected about you in the preceding 12 months, the business purpose for such collection, and corresponding categories of sources from which we collected the information,

    • the categories of personal information, and the categories of third parties to whom we disclosed your personal information in the preceding 12 months, and the business or commercial purpose for such disclosure,

    • the categories of personal information and the categories of third parties to whom we sold your personal information in the preceding 12 months, and the commercial purpose for such sale.

  • Request that we delete any personal information that we have collected from or about you. Note that there are some reasons we will not be able to fully address your request, such as if we need to complete a transaction for you, to detect and protect against fraudulent and illegal activity, to exercise our rights, for our internal purposes, or to comply with a legal obligation.

  • Request that we correct any personal information that we collect from or about you. Note that if we are not able to address your request, we will inform you. We may not be able to address your request if we are not able to verify your identity, if we consider that the totality of circumstances and determine that the information is more likely than not accurate, if your request to correct the same alleged inaccuracy has been denied within the past six months, or if we believe a request is fraudulent or abusive. We may choose to delete the contested information if such deletion does not negatively impact you, or if you consent to deletion.

  • Request that we limit the use of your sensitive personal data.

We value your privacy and will not discriminate in response to your exercise of your privacy rights. We will confirm receipt of your request within 10 business days and will respond to your request within 45 calendar days, after proper verification, unless we need additional time, in which case we will let you know.

 

E. Authorized Agents

You may authorize someone to make a privacy rights request on your behalf (an authorized agent). Authorized agents will need to demonstrate that you’ve authorized them to act on your behalf, and that they are registered with the California Secretary of State to conduct business in California, or must demonstrate they have power of attorney pursuant to applicable probate law. NLC Energy retains the right to request confirmation directly from you confirming that the agent is authorized to make such a request, or to request additional information to confirm the agent’s identity. An authorized agent is prohibited from using a consumer’s personal information, or any information collected from or about the consumer, for any purpose other than to fulfill the consumer’s requests, for verification, or for fraud prevention.

 

6. CHILDREN’S PRIVACY

Protecting children’s privacy is important to us. We do not direct the Services to, nor do we knowingly collect any personal information from, children under the age of thirteen.  If NLC Energy learns that a child under the age of thirteen has provided personally identifiable information to the Services, it will use reasonable efforts to remove such information from its files.

 

7. DATA SECURITY

We have taken certain physical, administrative, and technical steps to safeguard the information we collect from and about our customers and Services visitors. While we make every effort to help ensure the integrity and security of our network and systems, we cannot guarantee our security measures. 

 

8. DATA STORAGE

 

Your personal information is stored on servers in the United States; however, some of our brands, subsidiaries, parent company, and Service Providers may store information on servers hosted in other countries.  As such, your personal information may be subject to the laws of other countries, where the data protection and other laws may differ from those of the United States.  Your personal information may be disclosed in response to inquiries or requests from government authorities or to respond to judicial process in the countries in which we operate.

 

9. REVISIONS TO THIS PRIVACY POLICY

 

We reserve the right, at our sole discretion, to change, modify, add, remove, or otherwise revise portions of this Privacy Policy at any time. When we do, we will post the change(s) on the Services.  Your continued use of the Services following the posting of changes to these terms means you accept these changes.  If we change the Privacy Policy in a material way, we will provide appropriate notice to you.
